This Website is operated by Small Factory Innovations, Inc. ("we/our/us"). "You/your" means you as a user of the Website or the Service. “User” means all users of this Website or the Service. We offer this Website, including all information, tools and services available from this Website, to you conditioned upon your acceptance of all the terms, conditions, policies and notices stated here. Such tools and services are herein referred to as the “Service.”
1. Information about Districts, Schools, and Educators: When a school district, school, educator or other employee or contractor of a school (collectively an “Educational Organization”) sends us an inquiry or otherwise communicate with us by email, we will maintain your email in our database. When you create an account with us, we will also ask you for certain kinds of personal information, such as your name, email address, street address, telephone number, credit card number and other information that identifies you as an individual (“Personal Information”) to provide the services you request.
When you send us an email, fill out our contact form, or create an account, your email address will be added to our email list.
Student Data: Student Data is considered highly confidential. In using the Service, the Educational Organization may elect to input and store notes provided by the Educational Organization regarding an exercise that a child completed through the Service, voice recordings of a child, and a child’s first name and last initial (“Student Data”) on cloud based computers owned or controlled by us (“Our Cloud”). However, the Service can be used by an Educational Organization without inputting or storing any Student Data in Our Cloud or elsewhere. Student Data stored in Our Cloud is accessible by the Educational Organization and may be downloaded and stored locally (e.g., on a computer or flash drive) or deleted at any time by the Educational Organization. Our Cloud is protected by a firewall and permissive restrictions.
2. Use of Your Personal Information
We use the Personal Information we collect for various purposes, including:
- to manage your account with us
- to identify your preferences, so we can notify you of new or additional products, services, and promotions that might be of interest to you
- to improve our Website, our services, and your overall Website experience
- to communicate with you by email, postal mail, telephone, text message, or other means about our company, our products and services, or any other information that we believe may be of interest to you
Notwithstanding anything to the contrary, we will not use Student Data for any commercial or other purpose other than to provide the Service to the Educational Organization.
3. Sharing Personal Information With Third Parties
3.1 We do not share, sell or trade your Personal Information with any third parties, except with your consent or as described herein. We do not contribute to or participate in cooperative databases, which give other companies access to such Personal Information.
3.2 We may disclose your Personal Information when legally required to do so, to cooperate with law enforcement investigations or other legal proceedings, to protect against misuse or unauthorized use of the Website, to limit our legal liability and protect our rights or to protect the rights, property or safety of Users of this Website or the public.
3.3 We may also disclose your Personal Information to outside individuals and/or companies that help us bring you the products and services we offer and to create, operate, and maintain our Website and Service. For example, we may work with third parties to: (a) process payments you make to us; (b) manage a database of customer information, including, without limitation, Our Cloud; (c) assist us in distributing e-mails; (d) assist us with direct marketing and data collection; (e) provide data storage and analysis; (f) provide fraud prevention; (g) provide customer service; and (h) provide other services designed to assist us in developing and running our Website and maximizing our business potential. We require that these outside companies agree to keep all Personal Information shared with them confidential and to use the Personal Information only to perform their obligations to us.
3.4 In addition, if we go through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of our assets, your Personal Information will likely be among the assets transferred.
3.5 Our Website may allow users to post comments and other content to our Website. Any Personal Information that you post to our Website will become public information and will be accessible by other users of the Website. In addition, your user name will be viewable by other users, and we therefore encourage you to use a user name that is not your actual name. We have no responsibility to maintain the privacy or security of any such Personal Information that you may choose to post to our Website.

5. Non-Personally Identifiable Information
5.1 Through your use of this Website, we may also collect certain non-personally identifiable information from you (“NPII”). NPII is not associated with you as an individual. It is measured anonymously and only in the aggregate.
5.3 We may also use "pixel tags" (sometimes called "web beacons" or "clear gifs"), which are tiny graphic images, on the Website. Pixel tags help us analyze Users’ online behavior and measure the effectiveness of the Website and our Service. We may also use other analytical tools to evaluate site performance through the use of aggregated data, which contain no Personal Information. We work with service providers that help us track, collect, and analyze this information.
5.4 Cookies, pixel tags, and/or other analytical tools that we may use on the Website may collect information about your visit, including the pages you view, the features you use, the links you click, and other actions you take in connection with the Website. This information may include your computer's Internet protocol (IP) address, your browser type, your operating system, date and time information, and other technical information about your computer. We may also track certain information about the identity of the website you visited immediately before coming to the Website. We do not otherwise track any information about your use of other websites.
5.5 Cookies, pixel tags, and/or other analytical tools in our emails may be used to track your interactions with those messages, such as when you receive, open, or click a link in an email message from us.
5.6 We may also work with businesses that use tracking technologies to deliver advertisements on our behalf across the Internet. These companies may collect information about your visits to the Website and your interaction with our advertising and other communications, but no Personal Information is shared with them. These companies will not collect information about your use of or interaction with the Service and no advertising will be displayed through the Service.
5.7 We may combine the NPII collected through cookies, pixel tags and other analytical tools with other information we may have collected from you. This information may be used to improve our Website, to personalize your online experience, to help us deliver information to you, to determine the effectiveness of advertising, and for other internal business purposes.
6. Your Security
6.1 We strive to keep your Personal Information private and safe. We take commercially reasonable physical, electronic and administrative steps to maintain the security of Personal Information collected, including limiting the number of people who have physical access to database servers, as well as employing electronic security systems and password protections that guard against unauthorized access. Transport Layer Security encryption is used to protect the account registration process, sign-in information, and data transmitted to the Silas Solutions servers. In addition, it is our policy to never send your credit card number via e-mail. Please note that e-mail is not encrypted and is not considered to be a secure means of transmitting credit card information, so please do not send us your credit card number, or any other confidential information, by email.
6.2 Incident Response Plan: An incident response plan is in place which includes prompt notification of Educators and Districts in the case of a security breach.
6.3 Review or Deletion of Records Maintained by Silas Solutions: Contact your Education Organization directly to review, update, or delete your information or your child’s Student Data. Requests sent to Silas Solutions will be forwarded to the responsible Education Organization. Please be aware that even when records are modified or deleted, copies may be stored in archives and backups. 6.4 Data Retention: We will not retain any personally identifiable data beyond the scope necessary to provide services to your Educational Organization, other than copies which may be stored in archives and backups. Anonymized or aggregated data may be stored for internal analytical purposes.
Unfortunately, despite our best efforts, the transmission of data over the Internet cannot be guaranteed to be 100% secure. While we will use commercially reasonable means to ensure the security of information you transmit through the Website, we cannot guarantee that such information will not be intercepted by third parties.
7. Links to Other Websites
7.1 While visiting the Website, you may link to websites operated by third parties or you may have come to the Website using a link found in another website. In addition, we currently use third parties for our payment processing, and when you create an account with us, you will be directed to a third-party payment processor to complete your purchase. This does not mean that we endorse these websites or the goods or services they provide. We do not make any representations or warranties about any website that may be linked to the Website, including those of our payment processors. Such other websites are independent from us, and we have no control over, or responsibility for, their information, products or activities.
If you do not want to receive e-mails from us you may click on the “unsubscribe” link at the bottom of any email communication sent by us. Please allow us 10 business days from when the request was received to complete the removal, as some of our promotions may already have been in process before you submitted your request.
9. "Spoofing" And "Phishing"
A common Internet scam is known as "spoofing" or "phishing." This occurs when you receive an email from what appears to be a legitimate source requesting Personal Information from you. Please be aware that we will not send you any emails requesting you to verify credit card, bank information, or any other Personal Information. If you ever receive an email that appears to be from us requesting such information from you, DO NOT respond to it, and DO NOT click on any links appearing in the email. Instead, please forward the email to us at email@example.com, as we will investigate instances of possible Internet fraud.
10. Children and Privacy
Under the United States Children’s Online Privacy Protection Act ("COPPA"), verifiable parental consent is needed to collect, use, or disclose Personal Information from each User under 13 years old. In accordance with COPPA, an Educational Organization may act as the agent of a student’s parent or legal guardian and provide consent on behalf of the parent or legal guardian for our collection, use, and disclosure of student’s Personal Information. By allowing a student under 13 to use the Service, the Educational Organization provides such consent to us and agrees that the students’ activities while using the Service are subject to our Terms.
Notwithstanding anything to the contrary, we will not use Student Data for any commercial or other purpose other than to provide the Service to the Educational Organization.
Parent’s Choices Regarding Information on Students Under 13:
Under COPPA, parents of Students under 13 have certain rights with respect to our collection, use, retention, and disclosure of their Student’s information. This includes the right to review, update, or delete Student information, as well as prohibit our sharing Student information with third parties. Parents can exercise these rights by contacting the Student’s Educational Organization, and the Educational Organization should submit these requests, on the parent’s behalf, to us by emailing firstname.lastname@example.org. Notwithstanding any such requests, we may continue to share the Student information for non-Service purposes as described in Section 3, “Sharing Personal Information With Third Parties.”
A parent should request deletion of the Student’s information through the Educational Organization. Upon receiving such requests, the Educational Organization can delete the Student’s information itself or request deletion of the Student’s information by emailing email@example.com. This will delete the Student information from Our Cloud. We will not have any liability whatsoever for any termination of the account or related deletion of the Student information. When an Educational Organization deletes or we delete personal information, it will be deleted from our active databases but may remain in our backups and archives for up to 30 days
Under COPPA, Educational Organizations should always obtain parental consent for a Student under 13 to use the Service. It is the Educational Organization’s obligation to determine how best to obtain such consent which may including, without limitation, by individual consent form’s signed by parents or legal guardians, or by giving parents or guardian’s notice of the Educational Organization’s use of the Service through an Acceptable Use Policy for Internet use or otherwise.
If we learn we have collected or received Personal Information from a child under 16 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 16, please contact us directly at firstname.lastname@example.org.
Operators That Collect or Maintain Information from Children
No third party operators are permitted by us to collect Personal Information about children through our Website.
Users of the Service, however, may elect to store Student Data on Our Cloud. We utilizes the services of AWS and Microsoft to host data stored on Our Cloud. California residents under 16 years of age may have additional rights regarding the collection and sale of their personal information. Please see California Privacy Rights in Paragraph 11 below.
11. Your California Privacy Rights
11.1 Under California Civil Code sections 1798.83-1798.84, California residents are entitled to ask us for a notice describing what categories of Personal Information we share with third parties or corporate affiliates for those third parties or corporate affiliates' direct marketing purposes. That notice will identify the categories of information shared and will include a list of the third parties and affiliates with which it was shared, along with their names and addresses. If you are a California resident and would like a copy of this notice, please submit a written request to the following address: email@example.com. Please allow 30 days for a response. We do not currently share any Personal Information with any third parties or corporate affiliates for direct marketing purposes.
11.2 In addition, please note the following:
(a) Users can visit our Website anonymously;
(e) Users are able to change their Personal Information by emailing us or by calling us;
(f) Some Internet browsers include the ability to transmit “Do Not Track” signals that give you control over the collection and use of web browsing information. We honor "do not track" signals and "do not track", plant cookies, or use advertising when a Do Not Track browser mechanism is in place; and
(g) We allow the collection of users’ behavioral tracking (but not Personal Information) by third parties. We do not authorize the collection of Personal Information on the Website by third parties.
12. Disclosure for Legal Purposes
You hereby authorize us to disclose any of your Personal Information pursuant to judicial and administrative proceedings and to law enforcement or government agencies if we believe the disclosure is necessary or appropriate. You also authorize us to disclose Personal Information if we believe the disclosure is necessary or appropriate in the event of an investigation of improper or illegal conduct in connection with the Website, such as fraud, misrepresentation, intellectual property infringement, or other activity that may put us at risk for liability.
13. Non-Confidential Information
We do not want you to send to us any confidential or proprietary information through email or otherwise. Any information, materials, suggestions, ideas or comments sent to us will be considered non-confidential, and by submitting the same to us, you are giving us the absolute right to use, modify, reproduce, transmit, display and distribute the information for any purpose whatsoever, with no payment or other compensation to you. However, we will not use your name unless we are required by law to identify the source of the materials, information, suggestions, ideas or comments, or unless we first obtain your permission.
